As California’s largest wildfire moved swiftly, the internet speed in the area slowed to a crawl: Verizon choked it down to the first responders battling the Mendocino Complex blaze. Assemblyman Marc Levine, D-San Rafael, says a new law is necessary to protect first responders’ access to high-speed internet, although Verizon acknowledged the move and quickly apologized.

OPINION: California has long been at the forefront of Internet innovation. Now California stands to be the leader in a different way, substituting litigation for innovation. If legislation pending in the California Senate that would impose state level network neutrality requirements passes, it will almost certainly be struck down by the courts.

The latest skirmish in California-vs.-the-Trump-Administration is developing around the repeal of “net neutrality,” in which purveyors of internet access treat all data equally. The Federal Communications Commission, chaired by former Verizon executive Ajit Pai, repealed net neutrality in a Dec. 14 ruling on a party-line 3-2 vote, with the Republican commissioners in the majority.
