OPINION – Governor Gavin Newsom has expressed support for excluding trans girls from girls’ sports. This is a tempting position because it would seem “fair” to keep boys out of girls’ sports and “unfair” to let them play. This seductive idea appeals to emotions. But the premise is wrong.

The first openly gay teacher in San Francisco, he served on the board of San Francisco Unified School District and in the San Francisco Board of Supervisors, with future mayor, lieutenant governor and governor Gavin Newsom. A bill introduced recently aimed at ensuring the death certificates of transgender persons reflect their chosen gender is the latest legislative effort to vouchsafe the rights of this small category of Californians.

Six weeks before California’s first-in-the-nation law takes effect to guarantee certain rights to transgender students, foes of the new statute say they have collected enough signatures for a statewide referendum next year to let voters decide. The new law, signed by Gov. Brown in August after it was approved by the Legislature, takes effect Jan. 1.
