Judicial determinations of severability clauses

On occasion, bills in the California Legislature contain severability clauses. These types of bills contain multiple provisions and, when those types of bills are challenged in litigation, a court may be required to determine whether the valid provisions are “severable” from the law’s invalid provisions.

On any given day, thousands of jailed people are awaiting trial, sentencing or hearings in any of California’s 58 counties. Many are in custody because they cannot afford to post bail. Legislation to allow people to be free while their case is in the Legislature and its fate will be decided by midnight Aug. 31 when lawmakers adjourn.
