The state Supreme Court ruled unanimously Thursday that California’s undocumented immigrants are eligible to practice law if they meet licensing requirements — even though they are not citizens. The court’s decision involved Sergio C. Garcia, an undocumented immigrant from Chico who passed all qualifying state exams and was seeking a license to practice law in California. Arguments in the case were heard last year.
But a series of state court rulings are widely believed to mean that the pension offered current workers on the date of hire becomes a vested right, protected by contract law, that can only be cut if offset by a new benefit of comparable value. Santa Clara County Superior Court Judge Patricia Lucas said in her ruling the question before her court is “one of law, not of policy,” referring to a state Supreme Court response to city and county briefs on an Orange County attempt to cut retirement costs.
For the third time in five years, California lawmakers have rejected an attempt to give the California Coastal Commission, which has jurisdiction over 1,100 miles of coastline, authority to impose fines on those who violate coastal protection laws. Opponents of the plan were led by business, farm, petroleum and construction interests, and the measure failed after Assembly Democrats who backed it earlier withdrew their support.
Reduce Parolee Recidivism. This could include (1) improving or expanding current rehabilitation programs, (2) developing alternative sanctions for technical violations, or (3) better matching of programs and parolees.
